California Construction Defect Statute
For injury to property arising out of latent defects, an action must be brought within 10 years of substantial completion of the original construction of the improvement. CAL. CIV. PROC. CODE § 337.15. For injury to property, personal injury, or wrongful death arising out of patent defects, an action must be brought within 4 years of substantial completion; however, if injury occurs during 4th year, the action may be brought within 1 year after date of injury, but in no event may such an action be brought more than 5 years after substantial completion. CAL. CIV. PROC. CODE § 337.1.
